Main St\, Richmond\, VA 23219 \nAir Pollution Control Board meeting on the draft air permit for the proposed Atlantic Coast Pipeline compressor station in Union Hill.  At their November 9\, 2018\, meeting\, the Board voted unanimously to postpone a vote on the permit until their next meeting on December 10\, 2018.  (The December 10 meeting was postponed because of snow\, and will now be held on December 19.) \nIn an unprecedented action less than one week later\, on Thursday\, Nov. 15\, Governor Ralph Northam removed and replaced the two members of the Air Board most demanding of accurate information and environmental justice.  Any action by a uninformed and late packed board whose members have not all heard public opinion on the ACP compressor station is not legitimate.  Mark your calendars to attend the meeting and register your objections to the process.

DESCRIPTION:Thursday\, September 6\, 2018: Deny Special Use Permit/Zoning Variance for ACP in Augusta County. 1:30 pm\, Augusta County Government Center\, 18 Government Center Lane\, Verona\, VA 24482.  Turn out to make your voice heard! \nDominion has once again decided it wants to play by its own rules instead of those put in place by the citizens of Augusta County. On Thursday\, Sept. 6 at 1:30 p.m.\, the Augusta County Board of Zoning Appeals will hear another Special Use Permit request by Dominion and the Atlantic Coast Pipeline to put a pipe yard in an inappropriate place in our county. The meeting is at the Augusta County Government Center in Verona. \nYes\, that’s right – huge gravel parking lots\, 40-ft. light poles\, 250 workers’ vehicles and busloads of workers coming and going every day\, heavy equipment\, portable toilets\, piles and piles of pipe and other materials\, fuel storage\, noise\, industrial activities such as pipe fabrication\, single\, double\, and triple-wide trailers\, and 26 van trailers and large metal boxes for storage! All in the most rural part of western Augusta County –a place right now that hosts a cornfield. \n“Where is it this time?” you ask. Just off Rt. 250 in West Augusta at 717 West Augusta Road. And\, in addition to the 55-acre contractor yard with its three construction entrances\, this time Dominion also wants food trucks\, presumably for its hundreds of workers.  \nWe could go on about the traffic issues and illogical traffic counts associated with this proposal\, about the more than 150 students who will mix with that heavy construction traffic twice a day\, and about water issues and erosion and sediment control problems. If you are also worried about this\, we are asking that you do one or both of the following: \nMark your calendars and plan to attend the BZA hearing on Thursday\, Sept. 6 at 1:30 p.m. at the Augusta County Government Center in Verona. Plan to speak for 3 minutes or come to hear and support those who will be speaking and asking the BZA members to do the right thing and stand up for the county’s citizens and rules. \nTake a few minutes in the next few days to review the application in order to understand the magnitude of Dominion’s proposal and send an email message to BZA members through county staff John Wilkinson (jwilkinson@co.augusta.va.us) and Sandy Bunch (sbunch@co.augusta.va.us). You might thank them for having supported the community earlier this year and ask them to again listen to the people of the county. \nRemember that there is no harm in sending an email AND attending the meeting. Without the compressor station\, the ACP\, a robbery of and threat to all Virginians\, cannot be built. \nThis compressor station\, a giant one\, even by industry standards would bring loud constant noise and release toxic poisons into Buckingham’s air and water. The health of children is particularly vulnerable to the methane\, formaldehyde\, arsenic\, benzene\, xylene and other compounds the compressor will regularly release. The compressor station would create a fire and explosion hazard completely beyond the capacity of distant volunteer firefighters. They need your attendance at the Staunton Board of Zoning Appeals meeting\, Tuesday\, July 10\, 2018\, 2 p.m. in the Staunton City Council Chambers (116 W Beverley St.\, Staunton\, VA\, 24401). \nApparently Dominion has been storing heavy construction equipment\, buses\, and supplies for pipeline construction on a lot owned by Staunton Tractor off Richmond Avenue. The city of Staunton informed Staunton Tractor that creating a “contractor’s equipment storage area” is not a permitted use at that site. In a notice of violation sent to Staunton Tractor\, the city’s Planning & Zoning Division noted: “As we understand it\, this equipment is not part of your inventory for sale and is not present for repair work to be done on it. This part of the property is being used essentially as a contractors’ establishment\, serving as an operation staging site for a contractor.” \nStaunton Tractor has appealed the notice of violation\, asserting that the land is grandfathered in for storage of equipment and that the equipment is being stored there so that it can be repaired and maintained. \nThe matter will be heard by the Staunton Board of Zoning Appeals on Tuesday\, July 10 at 2 p.m. in the Staunton City Council Chambers. DESCRIPTION:On Thursday June 21\, 2018\, at 2pm Nelson County Service Authority will hold a public hearing on the proposed water rates in the proposed contract between the Service Authority and Dominion. The contract would allow the Service Authority to sell 40\,000 gallons per day of Wintergreen’s Lake Monocan water to Dominion to build the Atlantic Coast Pipeline\, specifically for the horizontal directional drilling (HDD) under the Blue Ridge Parkway at Reeds Gap. That’s 29 million gallons of water Dominion wants to buy over the next 2 years to build ACP and use for drilling fluid. \nAccording to the May 23\, 2018\, article in the Nelson County Times reporting on the Service Authority’s meeting on May 17\, which yielded no final decisions on a contract to provide water to the ACP for construction\, the board could vote on the contract following the public hearing. A public hearing is required to set the special rates for ACP. The ACP engineer attending the May 17 meeting said the water would be used for HDD\, but could be used for other aspects of construction\, and the water used as part of the HDD drilling fluid will be “hauled off.” [How? where? what will be done to purify it?]

The marathon meeting lasted nearly four hours and drew over 250 people\, nearly all of whom were in opposition to the permit. Over 40 people addressed the board to speak against the project\, whereas less than five people spoke in favor of it. The board will take more time to consider the proposal and where to go from here and revisit the request at its meeting in February….” \nThere was a great turnout for the January 4 meeting – let’s keep up the pressure at the continued discussion on February 1! \nAgents for the Atlantic Coast Pipeline will be seeking permission to get a special use permit to construct a 34-acre construction materials yard near Churchville at the intersection of Scenic Highway (Rt. 42) and Union Church Road. Dominion’s plan is to clear and level the existing farmland in order to stockpile pipe\, fuel tanks\, sand bags\, silt fencing\, equipment parts\, etc. and to provide parking for construction equipment\, employee trucks\, and office trailers. If approved this would be the staging area for a significant area of ACP construction in western Virginia for 2 years! \nHere are just a few reasons why we should turn out as a community and ask that the BZA deny this application: \n\nThink about this lovely rural setting and imagine the amount of heavy truck and equipment traffic fanning out in every direction along these narrow country roads on a 24/7 basis.\nConsider how this will affect the area’s water quality with every rain and snow event creating sediment runoff and with the amount of leaking\, dripping fuel from vehicles and equipment.\nVisualize how the farmland will look with stacks of 40-foot long\, 42-inch diameter pipe and a row of portable toilets.\nAnd\, as usual\, Dominion has pulled a switcheroo – this is not even the location of the pipe yard that Dominion submitted to FERC for approval.\n\nThe above reasons as well as concern from VDOT that the location doesn’t meet site distance (and therefore they don’t recommend approval)\, the concern from the county that the project doesn’t meet county code for a rural setting because the applicant doesn’t live on site\, and that this is legally incompatible with the rural conservation zoning of the area are all sound and logical reasons why this application should not be approved. \nFurther\, there are so many questions that Dominion has not answered about the site. For starters there is no traffic count analysis to know exactly what the increased volume of heavy trucks and equipment that will travel these narrow roads. There is no materials list to know what hazardous products might be stored on site (such as blasting materials)\, and there is no stormwater management or erosion and sediment control analysis\, something that the State Water Control Board is also waiting for in regard to the ENTIRE route in Virginia. \nPlease come to Verona on Thursday February 1 and express your concern for this application. SUMMARY:FERC Public Hearing on ACP DEIS - Monterey
DESCRIPTION:FERC public hearing in Monterey on the Draft Environmental Impact Statement for the ACP.  This is one of a series of meetings in our area. \nFERC says\, “If you wish to provide verbal comments\, the Commission staff will hand out numbers in the order of your arrival. Number distribution will be discontinued at 8:00 p.m. in order to ensure all comments are received by closing time. Comments will be taken until 9:00 p.m.” \nThere will be a 3-minute time limit for commenters. Assuming 15 minutes for preliminaries at the start and with perhaps a minute between speakers\, that means a maximum of 60 speakers. At the FERC scoping hearing in Nelson County in March 2015\, only 78 of the 203 people who signed up were able to speak before that meeting ended at 10:45 pm. Since we know from our experience at the 2015 hearings in Nelson and elsewhere that Dominion will try to front-load the commenters with pipeline supporters (many from out of area)\, come early to sign up to speak! \nVerbal comments will be recorded by a FERC-provided court reporter\, and the transcripts of comments will be posted in the ACP docket on the publicly accessible FERC Web site. FERC-posted transcripts from earlier hearings were often incomplete and inaccurate; we recommend you provide the court reporter with a written version of your comments\, and that you also submit them directly to FERC following the hearing.

Speakers’ comments will be taken in a private room with a stenographer. It is therefore crucially important that everyone who gives comments brings a paper copy to give to the stenographer and that everyone ALSO submits their comments to FERC so that there is an irrefutable paper trail!

SUMMARY:Buckingham Supervisors Public Hearing on Compressor Station
DESCRIPTION:A public hearing is set for Thursday\, January 5\, 2017\, at 6 p.m. for members of the Buckingham County Board of Supervisors to hear public comment on a requested special use permit for a 53\,515 horsepower natural gas-fired compressor station as part of the proposed Atlantic Coast Pipeline project.  The final decision on the permit needed for the station could come during the Board’s regular Jan. 9\, 2017 meeting. The public hearing will be held in the Peter Francisco Auditorium in the County Administration Complex on Route 60.\n \nBe there by 5:45 if you intend to sign up and speak. Better yet come earlier and join our song and prayer circle at the Arts center nearby\, 4:30 at the nearby Arts Building (it’s within walking distance of the Administration Building).  Gather for snacks\, draft or finish up your hearing comments\, sing\, pray\, and meet the organizers and activists from Buckingham who’ve fought this compressor station and pipeline for over 2 years!
