SUMMARY:Public Hearing: Water from Lake Monocan for ACP
DESCRIPTION:On Thursday June 21\, 2018\, at 2pm Nelson County Service Authority will hold a public hearing on the proposed water rates in the proposed contract between the Service Authority and Dominion. The contract would allow the Service Authority to sell 40\,000 gallons per day of Wintergreen’s Lake Monocan water to Dominion to build the Atlantic Coast Pipeline\, specifically for the horizontal directional drilling (HDD) under the Blue Ridge Parkway at Reeds Gap. That’s 29 million gallons of water Dominion wants to buy over the next 2 years to build ACP and use for drilling fluid. \nAccording to the May 23\, 2018\, article in the Nelson County Times reporting on the Service Authority’s meeting on May 17\, which yielded no final decisions on a contract to provide water to the ACP for construction\, the board could vote on the contract following the public hearing. A public hearing is required to set the special rates for ACP. The ACP engineer attending the May 17 meeting said the water would be used for HDD\, but could be used for other aspects of construction\, and the water used as part of the HDD drilling fluid will be “hauled off.” [How? where? what will be done to purify it?]

SUMMARY:Rally in Roanoke: Call for SWCB Meeting
DESCRIPTION:Citizen observers for the Mountain Valley Watch program have documented and reported as many as 20 erosion control violations to the Department of Environmental Quality since mid-April 2018. Yet DEQ has not issued any violation notices or warnings to the contractor or MVP LLC. The number and severity of problems should require an immediate investigation into the reported violations\, yet DEQ officials denied the existence of violations and problems during a recent court hearing in Roanoke. Virginia residents are justifiably concerned that DEQ is not fulfilling its responsibility to correct and enforce serious violations of state laws. \nA growing number of both individuals and groups are urging the State Water Control Board to immediately hold a meeting to determine the adequacy of the Army Corps’ Nationwide Permit 12 to protect the Blue Ridge region’s rivers\, streams\, and drinking water. The Board is not currently scheduled to meet until August 21 to consider the adequacy of the federal permit\, but in light of the ongoing problems and the daily\, direct harm to state waters from pipeline construction activities\, a decision on the permit cannot wait until late August. \nThere will be a rally with speakers to call for a prompt SWCB meeting on Monday\, June 18\, 2018 at 2:00 pm\, Wasena Park\, Roanoke\, VA (near Vic Thomas Greenway bridge by the Roanoke River). \nSpeakers include: \n\nDelegate Sam Rasoul\nRussell Chisholm\, Preserve Giles\nCynthia Munley Preserve Salem\nDr. Tina Smusz\, MD\, MPH\, health educator\nMary Beth Coffey\, landowner\nJason Shelton\, Mountain Valley Watch

SUMMARY:The Defenders: Protest Against Pipelines
DESCRIPTION:Help fund “The Defenders” – a massive protest sculpture symbolizing their brave resistance to fossil fuel destruction. \nErected in steel\, standing 8 feet tall and 8 feet wide\, “The Defenders” will make a strong anti-pipeline statement across the Valley. \nIt will amplify a message of action and protection. \nIt will inspire and engage more people to join the fight to resist domination by the fossil fuel industry. \nClimate change is upon us and we all need to do what we can to ‘build the best and block the bad.’ Fossil fuel infrastructure projects like the Atlantic Coast and Mountain Valley pipelines threaten people’s homes\, health\, safety\, and access to clean water. Ultimately\, these proposed projects harm all of us by deepening our region’s dependence on fossil fuels and accelerating climate chaos. \nThe Sculpture Action Vision for the Environment (S.A.V.E.) Sub-Committee\, Climate Action Alliance of the Valley wants to ‘block the bad’ with a strong symbol of resistance: “The Defenders” – a large\, moveable\, steel sculpture that will stand in defiance along these pipelines’ proposed paths. We have a sculptor team that has agreed to volunteer their time erecting this piece of protest art\, and landowners in Augusta\, Bath and Nelson Counties who will welcome the piece on their land\, close to the proposed pipeline route. (We are also exploring additional display sites). \nTo pull this off\, we need to raise $4\,000 to pay for the steel materials. The rest is in place to pull of this act of defiance. We need to act fast to make this statement\, as the pipeline plans continue to encroach on our lands and destroy Earth’s balances. \nJoin Climate Action Alliance of the Valley at Pale Fire Brewing Company on June 17th for The Defenders Preview Night. This event will kick off our fundraising campaign and lead into a month-long Kickstarter campaign that starts the following day. Please help us pull off this act of defiance by supporting us on June 17th and inviting your friends and family to join you. \nYou will have the chance to preview The Defenders model\, meet the sculptor team\, Mark Schwenk and Cheryl Langlais\, and have any questions you may have answered by the campaign organizers — all while enjoying Pale Fire’s great beer selection. We also hope to bring some local food vendors to offer delicious food for purchase on site! \nJoin the Climate Action Alliance of the Valley in making a strong statement of pipeline resistance in this act of solidarity with the many Defenders who are committed to stopping these projects. Checks and cash donations will be accepted to help us reach our $4\,000 fundraising goal. Keep an eye out for the launch of our Kickstarter campaign on June 18th!

SUMMARY:Festival of the [Monacan] River
DESCRIPTION:The Virginia River Healers have been invited to demonstrate at the Festival of the River in Richmond! Please join them on Saturday June 9\, 2018\, at 2:30pm. They will be using their presence to call attention to the threats of the Atlantic Coast Pipeline and Mountain Valley Pipeline. Show up and raise your voice for water justice! Show up and let Dominion and DEQ know how angry we all. DEQ and Dominion are sponsors of this 3 day festival for the river so let’s make a strong presence on Saturday. \nWhen: Saturday\, June 9th\, meet at 2:30pm\nWhere: Meet at the steps of the 7th street bridge on Browns Island. Richmond\, VA \nVirginia River Healers will have signs and banners ready to go and will be marching and demanding justice for our waters! This includes a call for Dominion Energy to stop work on the Atlantic Coast Pipeline and from horizontally drilling the so called James River for a fracked gas pipeline. At this very moment Dominion Energy and the Atlantic Coast Pipeline are preparing to horizontally drill the river\, a source of drinking water for over 3 million people. \nVirginia River Healers asks everyone in attendance to refer to the James River as the Monacan River and use this festival to also acknowledge the history of colonization and violence that has existed on this land long before the corporate violence of Dominion Energy and these pipelines. \nParking can be found at the corner of 5th and Tredegar St.

SUMMARY:Environmental Justice for Union Hill
DESCRIPTION:Come join concerned citizens to stand with Union Hill and Buckingham residents as they present the environmental justice issues to the Governor’s Advisory Council on Environmental Justice.  Wednesday\, May 30\, VCE Building\, 13327 West James Anderson Highway\, Buckingham.  Parking across the street at Maysville Baptist Church. \nAgenda:  9-10 a.m. – tour of Union Hill (for Council members only).  Public portion of the meeting:   10 a.m. – 4:30 p.m.  There will only be 25 minutes from 11:35 for individuals to make public comments related directly to the ACEJ subcommittee report and the DEQ presentation on the permit for the Union Hill Compressor Station. After that\, 12-1 in-council discussion on the subcommittee recommendations to the ACEJ. Lunch. Presentation. 1:50 -2:15 general public comment time.   Although\, individuals from Union Hill have had the opportunity to speak with ACEJ subcommittee members\, none of that was “on the record” of the ACEJ. So\, if possible\, during the 11:35am public comment time\, it would be a gesture of solidarity to allow the folks from Union Hill to present first person and scientific evidence of water\, air\, historic cultural\, erasures from FEIS\, etc to get these points in the public record.  \nThere is no planned rally outside the Coop building\, and we know there will be lots of allies who plan to stand in solidarity and to let the ACEJ know that they care deeply about environmental justice issues related to Union Hill. \nAdditional info here.

Governor Northam and First Lady Northam will be invited to this event to hear directly from landowners. \n*Landowners/community members that cannot attend – please feel free to send us a statement and we will read it during the event* \nPlease join us in support of the landowners who have been fighting these projects for over three years. SUMMARY:Pipelines in [so called] VA?! NO ~fracking~ WAY!
DESCRIPTION:Hosted by Virginia Student Environmental Coalition\, Charlottesville\nTuesday\, April 24 at 8 PM – 9 PM\nUniversity of Virginia\, Old Cabell Hall\, Room 107 \nMVP? ACP? Monopods? Tree sits? Resistance camps? Arrests?!\nWondering what all of this is about? \nFor years\, the profit hungry Dominion Energy\, Duke\, & EQT have been pushing two fracked gas pipeline projects on lands stretching from West Virginia through Virginia to North Carolina. Throughout the process\, politicians and regulators have consistently turned their backs\, tuning out the voices of those defending the land and the water. But countless courageous communities of resistance have fought back along both proposed routes\, successfully delaying construction… but not without sacrifice. \nVSEC Charlottesville will host a gathering (featuring *desserts*) for the Charlottesville community to catch our breath and find out how we move forward. Please come this Tuesday evening to learn more about these pipelines\, acts of resistance\, and histories of these lands. Also\, *ahem* COME EAT HOMEMADE DESSERTS!!!!

SUMMARY:Workshop: Native Plant Identification and Rescue
DESCRIPTION:Please join Blackberry Botanicals for a Native Plant Identification Workshop and Plant Rescue Training on Thursday April 12\, 2018 from 6pm – 8:30pm\, in the Rockfish Lounge at Rockfish Valley Community Center. This training session is for Landowners and Volunteers who would like to volunteer to rescue and transplant our native medicinal plant heritage. FREE and open to the public. Donations are accepted and appreciated. \nBlackberry Botanicals (BB) in conjunction with United Plant Savers is in the process of coordinating several plant rescue operations due to the destruction imminent in the path of several fracked gas pipelines that are coming through West Virginia and Virginia. The Appalachian mountains are home to over 500 verified varieties of medicinal plants many of which grow nowhere else in the world. BB is preserving these plants\, and preserving the rich and varied medicinal heritage of our Appalachian region. \nThe land clearing proposals and current practices observed during pipeline construction will negatively impact forest and wetland medicinals. This is a critical time to preserve these plants\, many of which will not survive if the controlled environment in which they flourish is damaged. Blackberry Botanicals (BB)\, along with a crew of dedicated volunteers\, are digging and replanting medicinals with growers who are actively participating in managed forestland plantings with verifiable practices of conservation. \nFollowing the April 12 informational meeting and training session\, BB will schedule several days to visit Nelson County in May 2018 to meet with interested landowners\, to walk the proposed pipeline route on landowner property\, and identify and mark native medicinal plants on the property. BB will return in June 2018 for several scheduled volunteer dig days. During these digs\, native medicinal plants will be carefully and sustainably harvested from their current location\, and either planted on the landowners property outside of the proposed pipeline route\, or will be safely transplanted to another local plant sanctuary or to the United Plant Savers Sanctuary in Ohio. \nIf you are a landowner or a potential volunteer in Nelson County and are interested in learning more\, please contact Sara Agelasto at sagelasto@gmail.com. If you would like to contact Blackberry Botanicals directly\, please email blackberrybotanical@gmail.com or call Beth at 304-923-3716.  (Blackberry Botanicals will have information at the Friends of Nelson Public Meeting on April 11 at RVCC.)

SUMMARY:Augusta BZA Consideration of ACP Construction Yard
DESCRIPTION:Augusta County Board of Zoning Appeals discussion – continued from January 4\, 2018 meeting. \nNews-Leader coverage of the January 4 meeting:  “The Augusta County Board of Zoning Appeals voted to delay making a decision Thursday on whether to issue the Atlantic Coast Pipeline a special use permit for a storage yard in Churchville. …. The marathon meeting lasted nearly four hours and drew over 250 people\, nearly all of whom were in opposition to the permit. Over 40 people addressed the board to speak against the project\, whereas less than five people spoke in favor of it. The board will take more time to consider the proposal and where to go from here and revisit the request at its meeting in February….” \nThere was a great turnout for the January 4 meeting – let’s keep up the pressure at the continued discussion on February 1! \nAgents for the Atlantic Coast Pipeline will be seeking permission to get a special use permit to construct a 34-acre construction materials yard near Churchville at the intersection of Scenic Highway (Rt. 42) and Union Church Road. Dominion’s plan is to clear and level the existing farmland in order to stockpile pipe\, fuel tanks\, sand bags\, silt fencing\, equipment parts\, etc. and to provide parking for construction equipment\, employee trucks\, and office trailers. If approved this would be the staging area for a significant area of ACP construction in western Virginia for 2 years! \nHere are just a few reasons why we should turn out as a community and ask that the BZA deny this application: \n\nThink about this lovely rural setting and imagine the amount of heavy truck and equipment traffic fanning out in every direction along these narrow country roads on a 24/7 basis.\nConsider how this will affect the area’s water quality with every rain and snow event creating sediment runoff and with the amount of leaking\, dripping fuel from vehicles and equipment.\nVisualize how the farmland will look with stacks of 40-foot long\, 42-inch diameter pipe and a row of portable toilets.\nAnd\, as usual\, Dominion has pulled a switcheroo – this is not even the location of the pipe yard that Dominion submitted to FERC for approval.\n\nThe above reasons as well as concern from VDOT that the location doesn’t meet site distance (and therefore they don’t recommend approval)\, the concern from the county that the project doesn’t meet county code for a rural setting because the applicant doesn’t live on site\, and that this is legally incompatible with the rural conservation zoning of the area are all sound and logical reasons why this application should not be approved. \nFurther\, there are so many questions that Dominion has not answered about the site. For starters there is no traffic count analysis to know exactly what the increased volume of heavy trucks and equipment that will travel these narrow roads. There is no materials list to know what hazardous products might be stored on site (such as blasting materials)\, and there is no stormwater management or erosion and sediment control analysis\, something that the State Water Control Board is also waiting for in regard to the ENTIRE route in Virginia. \nPlease come to Verona on Thursday February 1 and express your concern for this application. If you can’t attend (or in addition to attending)\, please communicate with the BZA board (click here for addresses) or email comments to the BZA secretary Sandy Bunch at sbunch@co.augusta.va.us and Community Development Director John Wilkinson at jwilkinson@co.augusta.va.us. Unlike Dominion\, the men and women on the BZA are from our community and care about your comments about our community. \nFor further information\, contact info@augustacountyalliance.org.

SUMMARY:Oral Arguments - BREDL vs Buckingham Board of Supervisors
DESCRIPTION:On January 29\, 2018\, in Buckingham Circuit Court\, residents opposed to the Atlantic Coast Pipeline compressor station will have their day in court.  Judge William Alexander will preside over oral arguments presented by opposing sides: E. M. Wright representing the defendant Buckingham County Board of Supervisors and Charles  M. Lollar representing the plaintiff Blue Ridge Environmental Defense League. \nAt issue are the pollution\, noise and unfair selection of the site in an historic African American community.  The case was initiated in 2017 by Blue Ridge Environmental Defense League working with local residents in the Union Hill community. In addition to BREDL and its chapter Concern for the New Generation\, thirteen local landowners living near the site of a proposed natural gas compression station are named in the petition. \nThe court hearing will begin at 11:00 AM on Monday\, January 29\, in Buckingham County Circuit Court (13061 West James Anderson Highway\, Buckingham VA 23921).  The hearing is expected to last an hour and a half.  Plaintiffs will hold a press conference immediately after the hearing. \nSynopsis of BREDL’s petition to the Court\, filed March 8\, 2017: \nTHE BLUE RIDGE ENVIRONMENTAL DEFENSE LEAGUE\, INC. et al\, v. Robert C. “Bobby” Jones\, Chair of Buckingham County Board of Supervisors\, et al\, Buckingham Co Cir. Ct. Case No. CL17000031-00 \nBlue Ridge Environmental Defense League\, a Virginia Corporation\, and its chapter Concern for the New Generation seek judicial review of the decision by the Buckingham County Board of Supervisors to grant special use permit 16-SUP236 for a natural gas compressor station in Buckingham County.  The Special Use Permit as approved by Buckingham County is contrary to existing zoning law and therefore invalid.  Further\, the action by the County was arbitrary and capricious.  Our goal is reversal and dismissal of the special use permit. The major issues presented are: 1) Excessive and harmful noise levels\, 2) Improper Local Governing Body Certification to Virginia\, 3) Improper zoning exception for pipeline as public utility\, and 4) Environmental justice under Commonwealth Energy Policy VAC § 67-101.
