DESCRIPTION:Come join concerned citizens to stand with Union Hill and Buckingham residents as they present the environmental justice issues to the Governor’s Advisory Council on Environmental Justice.  Wednesday\, May 30\, VCE Building\, 13327 West James Anderson Highway\, Buckingham.  Parking across the street at Maysville Baptist Church. \nAgenda:  9-10 a.m. – tour of Union Hill (for Council members only).  Public portion of the meeting:   10 a.m. – 4:30 p.m.  There will only be 25 minutes from 11:35 for individuals to make public comments related directly to the ACEJ subcommittee report and the DEQ presentation on the permit for the Union Hill Compressor Station. After that\, 12-1 in-council discussion on the subcommittee recommendations to the ACEJ. Lunch. Presentation. 1:50 -2:15 general public comment time.   Although\, individuals from Union Hill have had the opportunity to speak with ACEJ subcommittee members\, none of that was “on the record” of the ACEJ. So\, if possible\, during the 11:35am public comment time\, it would be a gesture of solidarity to allow the folks from Union Hill to present first person and scientific evidence of water\, air\, historic cultural\, erasures from FEIS\, etc to get these points in the public record.  \nThere is no planned rally outside the Coop building\, and we know there will be lots of allies who plan to stand in solidarity and to let the ACEJ know that they care deeply about environmental justice issues related to Union Hill. \nAdditional info here.

The gift will be valued at the $58 million (ACP) and $27.5 million (MVP) amounts of the Memorandums of Understanding that former Governor McAuliffe signed in secrecy and to allow a liability cap for the projects. The day’s events continue with a rally at the Capitol Grounds Belltower at 11am\, followed by a picnic lunch on Brown’s Island. \nWe invite affected landowners to share their stories at the Capitol Grounds event as we unveil a visual display of the 125-foot scar the ACP and MVP would produce for over 1\,000 miles across VA. All are invited to remind Northam to “listen to the science\,” come out in support of our land and water\, and DENY the Atlantic Coast and Mountain Valley Pipelines. DESCRIPTION:Please join Blackberry Botanicals for a Native Plant Identification Workshop and Plant Rescue Training on Thursday April 12\, 2018 from 6pm – 8:30pm\, in the Rockfish Lounge at Rockfish Valley Community Center. This training session is for Landowners and Volunteers who would like to volunteer to rescue and transplant our native medicinal plant heritage. FREE and open to the public. Donations are accepted and appreciated. \nBlackberry Botanicals (BB) in conjunction with United Plant Savers is in the process of coordinating several plant rescue operations due to the destruction imminent in the path of several fracked gas pipelines that are coming through West Virginia and Virginia. The Appalachian mountains are home to over 500 verified varieties of medicinal plants many of which grow nowhere else in the world. BB is preserving these plants\, and preserving the rich and varied medicinal heritage of our Appalachian region. \nThe land clearing proposals and current practices observed during pipeline construction will negatively impact forest and wetland medicinals. This is a critical time to preserve these plants\, many of which will not survive if the controlled environment in which they ﬂourish is damaged. Blackberry Botanicals (BB)\, along with a crew of dedicated volunteers\, are digging and replanting medicinals with growers who are actively participating in managed forestland plantings with verifiable practices of conservation. \nFollowing the April 12 informational meeting and training session\, BB will schedule several days to visit Nelson County in May 2018 to meet with interested landowners\, to walk the proposed pipeline route on landowner property\, and identify and mark native medicinal plants on the property. BB will return in June 2018 for several scheduled volunteer dig days. During these digs\, native medicinal plants will be carefully and sustainably harvested from their current location\, and either planted on the landowners property outside of the proposed pipeline route\, or will be safely transplanted to another local plant sanctuary or to the United Plant Savers Sanctuary in Ohio. \nIf you are a landowner or a potential volunteer in Nelson County and are interested in learning more\, please contact Sara Agelasto at sagelasto@gmail.com. DESCRIPTION:Augusta County Board of Zoning Appeals discussion – continued from January 4\, 2018 meeting. \nNews-Leader coverage of the January 4 meeting:  “The Augusta County Board of Zoning Appeals voted to delay making a decision Thursday on whether to issue the Atlantic Coast Pipeline a special use permit for a storage yard in Churchville. …. The marathon meeting lasted nearly four hours and drew over 250 people\, nearly all of whom were in opposition to the permit. Over 40 people addressed the board to speak against the project\, whereas less than five people spoke in favor of it. The board will take more time to consider the proposal and where to go from here and revisit the request at its meeting in February….” \nThere was a great turnout for the January 4 meeting – let’s keep up the pressure at the continued discussion on February 1! \nAgents for the Atlantic Coast Pipeline will be seeking permission to get a special use permit to construct a 34-acre construction materials yard near Churchville at the intersection of Scenic Highway (Rt. 42) and Union Church Road. Dominion’s plan is to clear and level the existing farmland in order to stockpile pipe\, fuel tanks\, sand bags\, silt fencing\, equipment parts\, etc. and to provide parking for construction equipment\, employee trucks\, and office trailers. If approved this would be the staging area for a significant area of ACP construction in western Virginia for 2 years! \nHere are just a few reasons why we should turn out as a community and ask that the BZA deny this application: \n\nThink about this lovely rural setting and imagine the amount of heavy truck and equipment traffic fanning out in every direction along these narrow country roads on a 24/7 basis.\nConsider how this will affect the area’s water quality with every rain and snow event creating sediment runoff and with the amount of leaking\, dripping fuel from vehicles and equipment.\nVisualize how the farmland will look with stacks of 40-foot long\, 42-inch diameter pipe and a row of portable toilets.\nAnd\, as usual\, Dominion has pulled a switcheroo – this is not even the location of the pipe yard that Dominion submitted to FERC for approval.\n\nThe above reasons as well as concern from VDOT that the location doesn’t meet site distance (and therefore they don’t recommend approval)\, the concern from the county that the project doesn’t meet county code for a rural setting because the applicant doesn’t live on site\, and that this is legally incompatible with the rural conservation zoning of the area are all sound and logical reasons why this application should not be approved. \nFurther\, there are so many questions that Dominion has not answered about the site. For starters there is no traffic count analysis to know exactly what the increased volume of heavy trucks and equipment that will travel these narrow roads. There is no materials list to know what hazardous products might be stored on site (such as blasting materials)\, and there is no stormwater management or erosion and sediment control analysis\, something that the State Water Control Board is also waiting for in regard to the ENTIRE route in Virginia. \nPlease come to Verona on Thursday February 1 and express your concern for this application. SUMMARY:Oral Arguments - BREDL vs Buckingham Board of Supervisors
DESCRIPTION:On January 29\, 2018\, in Buckingham Circuit Court\, residents opposed to the Atlantic Coast Pipeline compressor station will have their day in court.  Judge William Alexander will preside over oral arguments presented by opposing sides: E. M. Wright representing the defendant Buckingham County Board of Supervisors and Charles  M. Lollar representing the plaintiff Blue Ridge Environmental Defense League. \nAt issue are the pollution\, noise and unfair selection of the site in an historic African American community.  The case was initiated in 2017 by Blue Ridge Environmental Defense League working with local residents in the Union Hill community. In addition to BREDL and its chapter Concern for the New Generation\, thirteen local landowners living near the site of a proposed natural gas compression station are named in the petition. \nThe court hearing will begin at 11:00 AM on Monday\, January 29\, in Buckingham County Circuit Court (13061 West James Anderson Highway\, Buckingham VA 23921).  The hearing is expected to last an hour and a half.  Plaintiffs will hold a press conference immediately after the hearing. \nSynopsis of BREDL’s petition to the Court\, filed March 8\, 2017: \nTHE BLUE RIDGE ENVIRONMENTAL DEFENSE LEAGUE\, INC. et al\, v. Robert C. “Bobby” Jones\, Chair of Buckingham County Board of Supervisors\, et al\, Buckingham Co Cir. Ct. Case No. CL17000031-00 \nBlue Ridge Environmental Defense League\, a Virginia Corporation\, and its chapter Concern for the New Generation seek judicial review of the decision by the Buckingham County Board of Supervisors to grant special use permit 16-SUP236 for a natural gas compressor station in Buckingham County.  The Special Use Permit as approved by Buckingham County is contrary to existing zoning law and therefore invalid.  Further\, the action by the County was arbitrary and capricious.  Our goal is reversal and dismissal of the special use permit. According to a public notice from the commission the discussion will concern a conditional use permit (CUP) for a parcel of land on Salem Church road. The permit requests ‘allow(ing) borrowing and stockpiling of soil\, gravel and sand\, as well as utility operations\,’ according to the public notice. ‘The intended use is a temporary yard for storage of equipment and material for the Atlantic Coast Pipeline.’ According to the notice\, the request will cover 75 acres out of a 337-acre parcel. SUMMARY:Augusta BZA Consideration of ACP Construction Yard
DESCRIPTION:Come to the Augusta County BZA meeting Thursday Jan. 4\, 1:30 p.m. \nDespite nearly 3 ½ years of uniting our voices in opposition to Dominion’s disastrous pipeline plan\, the company continues to push forward with an unneeded project that will deeply and permanently decrease our community’s quality of life. On Thursday\, Jan. 4 at 1:30 p.m. at the Augusta County Board of Zoning Appeals (BZA) meeting in the Augusta County Government Center in Verona\, Dominion will again try to force another piece of their plan in place. And\, as usual\, they will be doing this without bothering to do their homework and study the impacts to the neighborhood. \nAgents for the Atlantic Coast Pipeline will be seeking permission to get a special use permit to construct a 34-acre construction materials yard near Churchville at the intersection of Scenic Highway (Rt. 42) and Union Church Road. Dominion’s plan is to clear and level the existing farmland in order to stockpile pipe\, fuel tanks\, sand bags\, silt fencing\, equipment parts\, etc. and to provide parking for construction equipment\, employee trucks\, and office trailers. If approved this would be the staging area for a significant area of ACP construction in western Virginia for 2 years! \nHere are just a few reasons why we should turn out as a community and ask that the BZA deny this application: \n\nThink about this lovely rural setting and imagine the amount of heavy truck and equipment traffic fanning out in every direction along these narrow country roads on a 24/7 basis.\nConsider how this will affect the area’s water quality with every rain and snow event creating sediment runoff and with the amount of leaking\, dripping fuel from vehicles and equipment.\nVisualize how the farmland will look with stacks of 40-foot long\, 42-inch diameter pipe and a row of portable toilets.\nAnd\, as usual\, Dominion has pulled a switcheroo – this is not even the location of the pipe yard that Dominion submitted to FERC for approval.\n\nThe above reasons as well as concern from VDOT that the location doesn’t meet site distance (and therefore they don’t recommend approval)\, the concern from the county that the project doesn’t meet county code for a rural setting because the applicant doesn’t live on site\, and that this is legally incompatible with the rural conservation zoning of the area are all sound and logical reasons why this application should not be approved. \nFurther\, there are so many questions that Dominion has not answered about the site. For starters there is no traffic count analysis to know exactly what the increased volume of heavy trucks and equipment that will travel these narrow roads. There is no materials list to know what hazardous products might be stored on site (such as blasting materials)\, and there is no stormwater management or erosion and sediment control analysis\, something that the State Water Control Board is also waiting for in regard to the ENTIRE route in Virginia. \nPlease come to Verona on Thursday and express your concern for this application. DESCRIPTION:Join us in Newport News on Thursday\, December 21\, 2017\, for a press conference and petition delivery to the Virginia Marine Resources Commission (VMRC)\, to demand the agency hold public hearings to hear affected landowners’ and communities’ concerns on the proposed Mountain Valley and Atlantic Coast fracked gas pipeline projects. \nWe will deliver a petition requesting that VMRC plan public hearings on MVP and ACP that are located convenient to landowners and communities on the proposed pipeline routes — rather than at the VMRC’s HQ\, 2+ hours away in Newport News. \nAdd your name to the petition:\nhttps://boldalliance.webaction.org/p/dia/action4/common/public/?action_KEY=24149 \nThe VMRC is responsible for issuing a state permit to both the MVP and ACP projects for specific water body crossings beneath the bed of streams and/or rivers with drainage areas greater than 5 square miles; these are considered to be State-owned subaqueous bottomlands of the Commonwealth (permit is a submerged Lands License under Virginia Administrative Code 4 VAC 20- 120-10 ET SEQ). \nThe VMRC is required to hold a public hearing as soon as there is a comment of protest to the projects (there has been). They typically hold public hearings in Newport News\, where their main offices are (2600 Washington Ave\, FL 3\, Newport News\, VA 23607). \nWe have a petition written to the head commissioner and the VMRC requesting that public hearings be held in proximity to the route of the proposed pipeline projects.
