SUMMARY:Cancelled - The Rights of Nature for the Community
DESCRIPTION:THIS MEETING HAS BEEN CANCELLED \nWednesday\, March 20\, 2019 at 7 PM – 9 PM\, Powhatan County Public Library\, 2270 Mann Rd\, Powhatan\, Virginia 23139. \nIf you are interested in protecting your county from environment harms\, come learn how we can work together to protect the Rights of Nature. We will have the opportunity to hear Ben Price\, from the Community Environmental Legal Defense Fund (CELDF)\, share information about the concept of Community Bill of Rights (CBOR) for our local communities and how to protect the rights of nature. 200 municipalities nationwide have already passed CBORs and over 3 dozen communities have protected the rights of nature in their local communities. Check out the CELDF website for more information. (www.CELDF.org) \nThe Constitution of Virginia says it is our right to clean air and clean water. However\, our rights conflict with the state and federal laws. As a systemic problem\, the law is built around the needs of the monied corporations. The law is on their side. We are looking at legalized harm. \nActivists in this movement often view the environment as the next frontier in humanity’s expanding moral circle: over the centuries\, we’ve extended rights to more and more beings (e.g. slaves\, women)\, so why shouldn’t nature itself be next? \nThe Lake Erie Bill of Rights (LEBOR)\, an amendment to the city charter of Toledo\, has just been voted on and passed. It is the first rights-based legislation aimed at protecting a whole US ecosystem: the lake\, its tributaries\, and the many species connected to it\, including humans! \nENOUGH IS ENOUGH\, PRESERVE VA rejects the conventional Western way of relating to nature — as property that is there for the taking\, as an object rather than a subject. We recognize that we are going to have to work within the existing Western legal system\, like the LEBOR mentioned above\, if we want that to change. \nWe are betting that the best strategy for protecting the environment is to stretch our society’s understanding of what can have rights. If corporations have rights\, why not nature? It’s a bold bet\, but with climate change decimating the planet at such a ferocious rate\, it is the kind of innovative thinking we need. \nThe LEBOR isn’t without precedent! It’s part of the nascent worldwide Rights of Nature movement\, which has notched several victories in the past dozen years. The Rights of Nature have been included in the constitution of Ecuador. Rivers and parks have already won legal rights in countries like Colombia\, India\, and New Zealand. \nJoin us to learn more about how to bring this paradigm shift to your local community!

SUMMARY:State Water Control Board Meeting
DESCRIPTION:At the State Water Control Board (Board) meeting on Dec. 13\, 2018\, a motion was approved to conduct a hearing to consider the revocation of Virginia’s Upland 401 Water Quality Certification for the Mountain Valley Pipeline project. \nAfter 8 weeks of delay\, during which construction of the Mountain Valley Pipeline has continued unabated despite over 300 DEQ filed violations of the water permit and a pending lawsuit against MVP by Virginia’s Attorney General\, the SWCB will discuss the issue without public input. Sigh. \nA special Board meeting to discuss this action has been scheduled for Friday\, March 1\, at 10 a.m. The meeting will take place at the DoubleTree By Hilton Hotel located at 1021 Koger Center Blvd.\, in Richmond. \n“We fully understand the level of intense public interest in the hearing that was discussed in December\,” said State Water Control Board Chair Heather Wood. “This is a unique situation and we need to ensure the proper legal process is followed. The Board will consider and discuss the next steps as a matter of law to ensure transparency and due process.” \nPlease note: \n— The hearing referred to at the Dec. 13\, 2018\, Board meeting will not occur at this special meeting on March 1; however\, it will be discussed by the Board. \n— Public comments are not received at special Board meetings. \n— The Board reserves the right to revise agendas without notice unless prohibited by law. \nThe full March 1\, meeting notice and agenda is available on the Virginia Regulatory Town Hall website at http://townhall.virginia.gov/L/meetings.cfm?time=future.

SUMMARY:Environmental Data Justice: Visions & Values
DESCRIPTION:Activists striving to create more livable shared futures are increasingly struggling with the discriminatory force of data. We need new practices and principles to wrestle with the fraught politics of data in justice work\, including environmental justice. Even as we may need to work with data\, data is always messy\, partial\, political and provisional. What frameworks and lessons might guide us? \nWe invite you to participate in creating the visions and values of what we might call “Environmental Data Justice.” This is an open online event for community organizers\, practitioners\, researchers\, and students working at the front lines of environmental and data justice struggles. All are welcome. \nWe hope that Environmental Data Justice might become a useful framework that ties together principles of Environmental Justice and Digital Justice in ways that help raise and address important issues of access\, anti-racism\, sovereignty\, consent\, and community control in response to increased surveillance and discrimination through data.  Building on the principles of environmental justice\, this event defines environment broadly to include urban spaces and issues of community conditions shaping life and public well-being\, in addition to important questions of pollution. \nWe invite you to join us in this co-learning event to share the lessons\, tools\, frameworks\, and guiding values from your Environmental and Data Justice projects. \nWhen: Thursday\, February 28\, 2019 at 7-9pm EST/ 4-6pm PST.   \nWhat: An online workshop sharing lessons learned and frameworks for environmental and data justice work. \nWhere: Register to receive a link. \nWho is invited: Community organizers\, practitioners\, environmental justice organizers\, data justice organizers\, academics\, students\, and anyone interested. \nFormat: The evening will be organized through panels of invited speakers who will give short talks to ignite our conversation and learning. SUMMARY:Air Pollution Control Board Hearing
DESCRIPTION:NEW DATE:  Wednesday\, December 19\, 2018 at 10 AM – 2:30 PM\, Pocahontas Bldg\, 1100 E. Main St\, Richmond\, VA 23219 \nAir Pollution Control Board meeting on the draft air permit for the proposed Atlantic Coast Pipeline compressor station in Union Hill.  At their November 9\, 2018\, meeting\, the Board voted unanimously to postpone a vote on the permit until their next meeting on December 10\, 2018.  (The December 10 meeting was postponed because of snow\, and will now be held on December 19.) \nIn an unprecedented action less than one week later\, on Thursday\, Nov. 15\, Governor Ralph Northam removed and replaced the two members of the Air Board most demanding of accurate information and environmental justice.  Any action by a uninformed and late packed board whose members have not all heard public opinion on the ACP compressor station is not legitimate.  Mark your calendars to attend the meeting and register your objections to the process.

SUMMARY:BREDL: Appeal to VA Supreme Court
DESCRIPTION:At noon on Tuesday December 4\, 2018\, the Virginia Supreme Court (100 North 9th Street\, Richmond) will hear the Petition for Appeal in Record # 180933\, Blue Ridge Environmental Defense League\, Inc. et al\, v. Robert C. “Bobby” Jones\, Chairman\, Buckingham County Board of Supervisors. \nThe challenge is to the Buckingham Board of Supervisors for their approval of a Special Use Permit for the proposed Buckingham Compressor Station in an agricultural zone\, and says that the SUP ordinance allows for exceptions for utilities\, but the ACP is a transmission line rather than a utility. \nChuck Lollar\, BREDL’s attorney\, encourages attendance by the public. The appeal asks the court to hear the case on its merits as it was previously dismissed due to technical omissions. If the court grants the appeal\, it will be sent to the Circuit Court.

SUMMARY:Public Hearing on ACP Flood Plain Crossings in Nelson County
DESCRIPTION:A Public Hearing will be held at 7 pm Monday December 3\, 2018\, in the auditorium at Nelson County High/Middle School (6919 Thomas Nelson Hwy\, Lovingston) to review four of the deferred floodplain variance applications submitted by the Atlantic Coast Pipeline in early 2018.  On January 31\, 2018\, ACP requested the deferrals until such time as they could provide the additional information requested by Nelson County on behalf of the BZA for these four applications to cross designated floodplains. \nThe Board of Zoning Appeals Web page has details about the ACP application as well as links to written comments on the requests submitted to the BZA. (Scroll down past the comments section to get to the links for the ACP application.) \nThose wishing to speak at the hearing will be required to sign in before the meeting. Nelson County has guidelines for speakers at hearings; note that speakers representing a group will have 5 minutes\, individual speakers will have 3 minutes (and may not allocate their time to another individual). \nThe hearing will address these four variance requests: \nVariance # 2018-007 \nConsideration of a request from Atlantic Coast Pipeline LLC for a Variance to construct a pipeline across a floodplain in conformance with Article 10 of the Nelson County Zoning Code for construction of a natural gas pipeline across property owned by Ronald Slaughter Jr. & Others\, 14815 Thomas Nelson Hwy\, Lovingston\, Virginia and further identified as Tax Map #45-A-25. \nVariance # 2018-008 \nConsideration of a request from Atlantic Coast Pipeline LLC for a Variance to construct a pipeline across a floodplain in conformance with Article 10 of the Nelson County Zoning Code for construction of a natural gas pipeline across the following properties: \n\n\n1434 Starvale Ln\, Shipman\, VA – owned by Gillis Rodgers\, and further identified as Tax Map #46-A-34. \n\n\nTax Map #46-A-12 – owned by Equity Trust Company \n\n\nVariance # 2018-009 \nConsideration of a request from Atlantic Coast Pipeline LLC for a Variance to construct a pipeline across a floodplain in conformance with Article 10 of the Nelson County Zoning Code for construction of a natural gas pipeline across property owned by James & Virginia Powell\, 884 Wheelers Cove Rd\, Shipman\, Virginia and further identified as Tax Map #59-A-23. \nVariance # 2018-010 \nConsideration of a request from Atlantic Coast Pipeline LLC for a Variance to construct a pipeline across a floodplain in conformance with Article 10 of the Nelson County Zoning Code for construction of a natural gas pipeline across properties owned by Greenway S Corporation\, Tax Maps #60-3-15\, 60-3-16\, and 60-A-28. \nSee a map of the FEMA floodplains on the ACP route. The blue dots on the map (look for them along the orange line that is the pipeline route) are the water crossings. The A (red)\, AE (yellow)\, and X (green) areas on the map are FEMA designated Floodplain Areas. A & AE are the most dangerous part of Floodplains\, called Special Flood Hazard Areas (SFHA)\, and any permanent structures are prohibited there\, with or without Higher Standards.
